4 typical influencer contract risks

📊 Ad-disclosure violations: fines up to €50,000 possible (§ 5a UWG, German Federal Court of Justice 2021)
Total buyout
up to€12,000
in usage rights handed over for free

The brand uses your content worldwide for 5 years. The market value of a buyout is 3–5× the post fee — usually granted with no surcharge at all.

The ad-disclosure trap
up to€50,000
in fines for missing disclosure

Under Werbekennzeichnung (Germany's ad-disclosure rules) you are personally liable, not the brand. Cease-and-desist actions start at €5,000 (§ 5a UWG, BGH).

Industry-wide exclusivity
up to€20,000
in lost income over 6 months

6 months without any beauty or fitness brand = 5–10 lost collaborations. Often disproportionate (§ 307 BGB).

The KSK trap
up to€500
lost per deal

The brand deducts the 5% artists' social levy from your fee — not allowed: the KSK (Künstlersozialkasse — German artists' social insurance) levy is owed by the company, not the artist.

High risk found? The Lawyer Check takes over.

If the analysis shows a high risk, you can forward your contract with a case summary to an independent German lawyer in one tap — referred through the advocado partner network. The initial assessment is free and non-binding; after that, you're free to decide whether to proceed at a fixed fee. How the Lawyer Check works →

★★★★★

“My brand deal had a worldwide, unlimited total buyout. SignGuard flagged it — I limited the buyout to 6 months in the DACH region and negotiated a €3,500 surcharge.”

Frequently asked questions

What does SignGuard check in an influencer contract?
SignGuard analyzes every clause on total buyout, ad-disclosure duties (Werbekennzeichnung — Germany's ad disclosure rules), exclusivity, KSK (Künstlersozialkasse — German artists' social insurance) and fee models, and rates each one against German case law (BGH), the UWG and KSK rules. When do I have to label a post as an ad in Germany?
As soon as you receive anything in return for a post (money, free products, a trip), it MUST be labeled as advertising (§ 5a UWG — Werbekennzeichnung, Germany's ad-disclosure rules). Germany's Federal Court of Justice (BGH 2021, the Cathy Hummels line of cases) requires “Werbung” (advertising) or “Anzeige” (ad) at the start of the caption; in stories, an “advertising” sticker. Otherwise, cease-and-desist actions of €5,000–50,000 are possible. Ad disclosure on Instagram & Co. (German) → Using AI images or voices? ⚖️ Tools compared

Checking an influencer contract — your options in 2026

For influencer and UGC contracts there is no established 1:1 competitor app as there is for rental contracts — the market splits into four categories. SignGuard is the digital clause-level first orientation from the creator's perspective.

Option Category Focus / strength Cost
SignGuard AI clause check Total buyout, exclusivity, ad disclosure, the KSK lever — in 60 sec, from the creator's perspective; GDPR + EU-based servers 3 free, then from €4.99/month
Specialist lawyer (creator/IT law) Advice & negotiation Individual case review, negotiation support for complex buyouts or disputes — legally binding, tailored €200–500/case
Talent/influencer agency Contract management Deal-making + contract handling — but the agency earns on every deal (a conflict of interest when reviewing) 15–20% of the deal
Deutscher Werberat (German Advertising Standards Council) Self-regulation Complaints body for § 5a UWG ad-disclosure violations — an official resource, but retrospective free
Verbraucherzentrale (consumer advice center) Public advice Advice on basic contract-law questions (in person, regional) — good for escalating a dispute €20–50

Rule of thumb: Before signing — SignGuard for the clause-level first check (60 sec., 3 free). For complex negotiations or disputes: a specialist lawyer. Werberat + Verbraucherzentrale are public resources for special questions.
